Man wins $7.5 million suit against Starbucks

 

VISTA — A Vista Superior Court jury on Friday ordered Starbucks to pay a chiropractor and his family $7.5 million as compensation for a 2008 slip-and-fall accident that left him with a brain injury.

 

The amount, decided upon after a 2½-week trial, compensates Anthony Zaccaglin, 51, and his family for loss of income, medical expenses and the loss of enjoyment of life, court records show.

 

The March 20, 2008, incident occurred at the Starbucks on Melrose Drive near the Vista courthouse.

 

Zaccaglin bought a drink at the cash register and was walking to the other end of the counter to pick up his order when he slipped and fell, striking his head on the tile floor, according to his attorney, John Gomez.

 

A Starbucks employee had just mopped the area, Gomez said. A store manager testified that she put out three “wet floor” cones, but other witnesses said they saw only one, the attorney said.

 

Zaccaglin went to a doctor the next day with persisting head pain, nausea and other symptoms and was told he suffered from a concussion. Doctors later diagnosed him with mild brain trauma, for which Zaccaglin underwent 1½ years of brain-injury therapy, Gomez said. He has not been able to return to his job. He resides in Menifee.

 

A Starbucks spokesman said in a statement that providing a safe environment for customers is a top priority, and the company was sorry Zaccaglin was injured at its Vista store.

 

“However, we are disappointed with the size of the verdict as we made every effort to reach a mutually agreeable and reasonable settlement with Mr. Zaccaglin,” the statement said. “We are reviewing the decision to determine what, if any, steps we may take in response.”

 

Gomez disputes Starbucks’ claim, saying the Seattle-based company never offered more than $100,000 to settle the case.
